These Terms and Conditions ("Agreement") govern your use of the ORCA Academy website ("Website"). By accessing or using the Website, you signify that you have read, understood, and agree to be bound by this Agreement. If you do not agree to abide by these terms and conditions, please refrain from using the Website.

Definitions
- "ORCA Academy" or "we" refers to our company, ORCA Academy. - "Customer" or "student" refers to any individual, company, corporation, or organization placing an order with us.

Availability and Pricing
We make every effort to ensure that the prices, detailed information, and sizes of the products on our Website are up to date. Prices are subject to change without further notice, and all orders are subject to our sole discretion as to whether they are accepted and provided with stock.

We also strive to ensure that the products displayed on our Website are in stock. In the event of any product being out of stock from time to time, we reserve the right to provide substitute products of similar value and style.

All orders are subject to the final availability of supply, and we reserve the right to refuse orders if any requested product or service is unavailable.

Member Registration

To become a member, you must first register as a member user and then place an order through our Website. During the registration period:

- You must provide accurate, complete, and up-to-date registration information.

- You must protect your username and password.

- You authorize us to assume that anyone using the online store with your username and password is you or is authorized to act on your behalf.

- We have the absolute discretion to refuse registration of potential customers and to terminate the registration of any customer for any reason.

If there are any changes to the information you provided, please notify us immediately through our Website, WhatsApp, email, or phone so that we can communicate with you effectively.

Equipment/Item Arrangement

- Customers/students must bring their own admission fee. Adults: 19 HKD, children: 7 HKD. If you want to store personal belongings in the locker, please bring 5 HKD or 2 HKD.

- If the swimming class takes place in a private club or residential estate, guests must pay the entrance fee for the coach.

- Customers/students must bring swim boards (triangular boards), floating backs, swimming caps (available for purchase from us), swimming goggles (available for purchase from us), thermal wetsuits (available for purchase from us), sun protective clothing, earplugs (if needed), swimming attire, large towels, shower gel, and slippers for warm/hot water to use after getting out of the water.

課程期限及請假安排

  課程自首堂日期起計，學員須於兩個月內完成該期課程。一經確認日期並繳費，恕不接受更改或退款。
  如須臨時請假，請於12小時前通知本院及教練，以便協調安排。私人或病假可獲一次補堂機會（暑期班除外）。

暑期班條款
  暑期游泳班不設私人或病假補堂。如因惡劣天氣取消課程，可另行安排補堂。
  學員請於課程開始前5至10分鐘抵達場地，以確保準時上課。

Staffing Arrangements

If a customer wishes to retain the regular coach, please send a WhatsApp notification for renewal arrangements before the end of the term (4th class).

惡劣天氣安排

 如公眾泳池開放，課程將如常進行；若會所泳池因雷暴警告、3號或以上風球、紅色/黑色暴雨警告而關閉，課程將取消並另作安排。
– 如課堂已進行超過30分鐘，恕不設補堂。
– 如課堂少於30分鐘，可補回剩餘時間。
– 學員因私人理由中途離開，不設補課或補時安排。

- No make-up classes will be offered if you need to leave early due to weather or personal reasons.

- Please contact your coach 2-3 days before the new class to confirm details.

補課安排

  學員如已提出有效請假，可於指定補堂限額內申請補課。補堂時間及地點由本院及教練協調後決定，學員不得異議或缺席。

Privacy Protection

We are committed to protecting individuals' privacy concerning personal data. Our policies and practices regarding the collection, use, retention, transfer, and access of personal data comply with the requirements of Hong Kong law under the Personal Data (Privacy) Ordinance (Cap. 486).

Payment

Our Website accepts payment by designated credit card, debit card, or other designated electronic methods as specified by us. All product prices listed are in Hong Kong dollars.

Acceptance of orders is at our sole discretion. Goods will be delivered to your address upon payment.

Payment method

We accept Visa, WeChat Pay, Tap & Go，Payme，Boc pay， Alipay, fast speed, MasterCard and Paypal.

If there are any other delivery fees, they will be listed separately for your confirmation before payment.

費用及退款政策

  所有課程及會籍費用一經繳交，無論任何情況，均不設退款。

會籍終止條款

  學員如於有效會籍期間申請特別退出安排（僅限本院認可之特殊情況），須退回曾獲贈之物品（如泳帽每頂港幣80元），並補繳相關會籍折扣差額。

課程確認及更改程序

  請學員於新一期課程開始前2至3日與教練確認上課安排。如需更改場地、時間或日期，須同時通知本院記錄，以避免安排失誤。

Ownership of Filmed Content

Any student's swimming skills filmed or videotaped by the instructor during class will be owned by the company.

Modifications to Terms and Conditions

ORCA Academy reserves the right to change the terms and conditions of use at any time without prior notice. In case of any dispute, ORCA Academy reserves the right of final decision.

Governing Law and Dispute Resolution

All terms and conditions shall apply to the extent permitted by the laws of the Hong Kong Special Administrative Region. The Company may modify these terms and conditions at any time without prior notice. In the event of any dispute, our decision shall be final.
